Indiana also has very strict open container and consumption in vehicle laws. A Class C infraction is not considered a moving violation, but if the person has a prior unrelated conviction or judgment under this law or a prior charge within the previous twelve months under this chapter, the court could suspend that person’s driving privileges for up to one year. A driver caught consuming alcohol while the vehicle is moving on a public highway will be charged with a Class B infraction and may be fined up to $1000.
