A second OWI violation within a period of five
years from your original conviction, or if
someone get seriously hurt and you are found
to be driving with a BAC of .08 or higher, or
have a controlled substance or its metabolite
in your body, you will be charged with a Class
D Felony. This violation carries a jail time
of up to three years and a fine of up to $10,000.
In the event that a person dies because of the
accident or injury, you will be charged with
a Class C Felony. This
felony is punishable by jail time of up to eight years
and a fine of up to $10,000. If you have a prior OWI
conviction within the previous five years, you will
be charged with a Class B Felony. A Class B Felony
is punishable with jail time of up to 20 years and
a fine of up to $10,000. In either case, if more than
one person is hurt or dies, Indiana law allows for
a separate charge for each individual that is hurt
or killed.
Consequences for Impared Driving in Indiana:
- Both you and your vehicle will be searched.
- You will have to take a certified breath test.
- Refusal to take the test will result in the automatic suspension of your license for one year.
- If your BAC is .08 or higher, your license will be suspended for minimum of 30 days.
- Your car will be towed and impounded at your expense.
- You will be handcuffed and processed at the local police station.
- You will have to post bail to be released from jail.
