If you are arrested for drunk driving in Indianapolis:
- You and your car will be searched.
- You will have to take a certified breath test.
- Your license will be suspended for at least 30 days, if your BAC is .08% or higher.
- Your license will be suspended for one year, if you refuse the test.
- Your car will be towed and impounded.
- You will be handcuffed and processed at the police station.
- You will have to post bail to be released from jail.
A second OWI conviction within a period of five years is considered a Class D Felony. This felony is punishable by a prison sentence of up to three years and a fine of up to $10,000. If a person is injured while you are driving with a BAC of .08 or higher, you will also be charged with a class D Felony. However, if you have another OWI conviction within the past five years, your charge will elevated to a Class C Felony. This charge will also apply to a first OWI conviction if anyone is killed while your BAC is .08 or higher. A Class C Felony is punishable by up to eight years in prison and a fine of up to $10,000. If you have a previous OWI conviction within a five year period, you will be charged with a Class B Felony. This offense carries a prison sentence of up to twenty years and a fine of up to $10,000. You will be charged separately for each person hurt or killed.
